Terms of Service & Course Enrollment Agreement

By checking the agreement box and enrolling in any course or certification program offered on this website, you agree to be bound by the following legally binding Terms of Service.


1. Certification and Passing Requirements

Enrollment in, payment for, or attendance in any course guarantees access to the instructional training materials and lectures only. Payment does not guarantee certification or a passing grade. To earn your certification, you must independently satisfy all requirements set forth by the official governing bodies, including but not limited to attending mandatory hours and achieving a passing score on the official examination. The Instructor is not responsible for a Student's failure to study, prepare, or pass the required exams.


2. Adherence to Certifying Body Rules and Conduct

All certification courses are strictly administered under the official guidelines and regulations of the respective certifying organization (Pool & Hot Tub Alliance / PHTA). Students are required to maintain professional conduct and absolute academic integrity. Any form of cheating, plagiarism, unauthorized sharing or copying of exam materials, or disruptive behavior during instruction will result in immediate expulsion from the course. In the event of expulsion for rule violations, the Student forfeits all registration fees, and no refunds will be issued.


3. Field Application and Indemnification

The training provided is intended to teach established industry standards at a specific point in time. Certification demonstrates solely that the Student completed the coursework and met minimum testing benchmarks; it does not constitute an insurance policy, warranty, or ongoing endorsement of the Student’s subsequent work.


Once you complete the course, you are solely responsible for your actions, safety protocols, and field execution. By enrolling, you agree to indemnify, defend, and hold harmless the Instructor, website owner, and affiliates from any and all claims, damages, liabilities, injuries, or losses (including property damage, chemical accidents, or commercial pool closures) arising from your practical application of the course material or professional mistakes in the field.


4. Intellectual Property Restrictions

All course content, including videos, downloadable guides, custom pool calculators, templates, and text, is the exclusive intellectual property of the Instructor and is protected by copyright laws. Your enrollment grants you a single, non-transferable license for personal, educational use only. You are strictly prohibited from copying, recording, redistributing, or reselling any course materials, or using them to train un-enrolled third parties.


5. Fees, Cancellations, and Refunds

All fees must be paid in full prior to gaining access to online course modules or attending live sessions. Due to the digital nature of the prep materials and the limited seating for certification slots, all sales are final.


Cancellations/Rescheduling: If you need to reschedule a live class or exam date, you must notify us at least 1 day before the scheduled start time. Failure to show up or request a reschedule within this window will result in a forfeiture of your seat and registration fees.

 

 

Privacy Policy


This Privacy Policy describes how we collect, use, and disclose your personal information when you visit our website, sign up for our newsletter, or purchase our pool maintenance and CPO courses.

2. How We Use Your Information

We use the data we collect to:


Deliver, manage, and track your progress through our pool maintenance courses.


Process your payments and issue receipts or certificates of completion.


Send you course updates, instructional emails, or promotional newsletters (you can unsubscribe at any time).


Analyze website traffic to improve our articles, tutorials, and user experience.


3. Information Sharing and Disclosure

We do not sell or rent your personal data to third parties. We only share your data with trusted service providers who help us run our business, including:


Payment processors to securely handle transaction data.



Email marketing platforms to deliver newsletters and course notifications.


Analytics providers to evaluate site performance.


Note: We may disclose information if required by law to comply with a subpoena, court order, or legal process.


4. Data Security and Retention

We implement industry-standard security measures to protect your data from unauthorized access or theft. We retain your personal information only as long as necessary to provide you with access to bought courses, maintain business records, or comply with legal obligations.


5. Your Rights and Choices

Depending on your location, you may have rights under regional privacy laws (such as GDPR or CCPA) to access, correct, delete, or restrict the use of your personal data. You can opt out of analytics tracking by disabling cookies in your browser settings. CPO Certification: Cancellation, Transfer & Retake Policy


We understand that schedules change, and we aim to be as flexible as possible while maintaining our course commitments. Please review our policies below regarding refunds, transfers, and exam retakes.



1. Cancellation & Refund Policy


  • Before the Live Zoom Session: If you need to cancel your registration before the start of the live Zoom portion of the course, you are eligible for a partial refund. The maximum refund amount is $230 (to account for non-refundable digital materials, administration fees, and seat holding).


  • After the Zoom Session Begins: Once you attend or log into the live Zoom portion of the course, no refunds will be issued under any circumstances.



2. Course Transfer Policy


If you cannot make your scheduled course date but still wish to take the certification, you may transfer to a future session:


  • First Transfer: FREE (No additional charge).


  • Subsequent Transfers: Any additional transfers (second time or more) will incur a $50 administrative fee per change.



3. Exam Retake Policy

We want to help you pass! If you do not pass the CPO exam on your first attempt:


  • First Two (2) Retakes: FREE.



  • Additional Retakes: If a third attempt (or more) is required, a $50 fee will be charged for each additional retake.


How to Request a Change: To cancel your registration, request a course transfer, or schedule an exam retake, please contact us immediately at shannon@spickandspanpools.com. All requests must be made in writing before the start of your scheduled Zoom class.
